Terms of Service

1. Acceptance of Terms

By accessing or using the GetAPI Omni platform (the "Service", "we", "us", "our"), including the website at api.getapiomni.com and its associated APIs, dashboards, documentation and billing functions, you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, you may not use the Service.

2. Description of Service

GetAPI Omni provides a unified AI API gateway that enables developers and businesses to access a range of AI model capabilities through a single, OpenAI-compatible interface. The Service includes account management, API key issuance, usage tracking, and billing/payment processing through integrated payment providers.

3. Eligibility

You must be at least 18 years old and capable of entering into a binding contract to use the Service. By using the Service, you represent and warrant that you meet these requirements and that your use of the Service complies with all applicable laws and regulations in your jurisdiction.

4. Accounts and API Keys

1. You are responsible for maintaining the confidentiality of your account credentials and API keys.
2. You must promptly notify us of any unauthorized use of your account or API keys.
3. We reserve the right to suspend or terminate accounts used in violation of these Terms.

5. Acceptable Use

You agree not to:

• Use the Service for any unlawful purpose or in violation of any applicable law;
• Attempt to reverse engineer, decompile, disrupt, or tamper with the Service;
• Resell or redistribute access to the Service except as expressly permitted;
• Use the Service to generate, store, or disseminate illegal, infringing, or harmful content;
• Impersonate others or misrepresent your affiliation with the Service;
• Interfere with or circumvent security controls, rate limits, or anti-abuse measures.

6. Fees and Payment

1. Certain features of the Service are paid. Applicable fees are displayed before purchase and are charged through our integrated payment providers (such as Waffo, PayPal, Alipay, and WeChat Pay).
2. All payments are non-refundable except as set out in Section 7 or as required by applicable law.
3. Prices may change from time to time. Changes will apply to future purchases only.

7. Refunds

We do not offer refunds for prepaid credits or usage fees except where required by applicable consumer law or where we have materially failed to provide the Service. Refund requests may be submitted to our support contact within fourteen (14) days of the relevant charge and will be reviewed on a case-by-case basis.

8. Intellectual Property

1. The Service, including its software, interfaces, documentation, and branding, is owned by GetAPI Omni and is protected by applicable intellectual property laws.
2. You retain all rights to the content and data you submit to or process through the Service. You grant us a limited license to process such data solely for the purpose of providing the Service to you.

9. Third-Party Services

The Service integrates with third-party AI model providers, hosting providers, and payment processors. We are not responsible for the availability, quality, or legal compliance of third-party services or models. Your use of any third-party service is governed by that provider's own terms and policies.

10. Disclaimer of Warranties

The Service is provided "as is" and "as available", without warranties of any kind, whether express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the Service will be uninterrupted, error-free, or secure, or that AI model outputs will be accurate, complete, or reliable.

11. Limitation of Liability

To the maximum extent permitted by law, in no event shall GetAPI Omni, its operators, affiliates, or licensors be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits, revenues, data, or goodwill, arising out of or in connection with your use of the Service. Our total aggregate liability shall not exceed the amounts you paid to us in the twelve (12) months preceding the claim giving rise to liability.

12. Indemnification

You agree to indemnify and hold harmless GetAPI Omni and its operators from any claims, damages, liabilities, and expenses (including reasonable legal fees) arising out of your use of the Service or your breach of these Terms.

13. Termination

1. We may suspend or terminate your access to the Service at any time for violations of these Terms or for operational reasons, with notice where practicable.
2. Upon termination, your API keys will cease to function and you remain responsible for any outstanding fees incurred before termination.

14. Changes to These Terms

We may update these Terms from time to time. The current version will always be available at this page. Material changes will be communicated through the Service or by email. Continued use of the Service after changes take effect constitutes acceptance of the revised Terms.

15. Governing Law and Dispute Resolution

These Terms shall be governed by the laws of Hong Kong SAR, without regard to conflict-of-law principles. Any dispute arising out of or in connection with these Terms shall first be addressed through good-faith negotiation; if the dispute remains unresolved, it shall be submitted to the competent courts of the governing jurisdiction.

16. Severability and Entire Agreement

If any provision of these Terms is held to be invalid or unenforceable, the remaining provisions shall remain in full force and effect. These Terms constitute the entire agreement between you and GetAPI Omni with respect to the Service.
